Ijtimoiy tarmoq giganti Meta chorshanba kuni Nyu-Meksiko sudi tomonidan 25 milliard dollar jarima to'lashga majbur qilindi. Bu 2018-yilda oshkor bo'lgan kompaniyaning Cambridge Analytica ma'lumotlar janjali bilan bog'liq ma'lumotlar maxfiyligi bo'yicha sud ishi doirasida sodir bo'ldi.
Associated Press, New York Times, Reuters va Wall Street Journalning bir nechta xabarlariga ko'ra, shtat okrug sudi sudyasi Frensis J. Matyu Meta va Facebookni shtatdagi iste'molchilarning maxfiyligi haqida yolg'on bayonotlar berganlikda aybladi.
"Facebook foydalanuvchilarga ular (foydalanuvchilar) o'z ma'lumotlarini nazorat qilishini va'da qildi," deb yozdi Matyu o'z qarorida. "Bu yolg'on edi."
Jarima shtatning adolatsiz amaliyotlar to'g'risidagi qonunining 43 milliondan ortiq buzilishi bilan bog'liq. 2021-yilda berilgan da'vo, Britaniyaning siyosiy maslahat firmasi Cambridge Analytica millionlab Facebook foydalanuvchilarining ma'lumotlarini ularning roziligisiz psixografik profillar yaratish uchun olganligi haqidagi ma'lumotlar oshkor bo'lishi ortidan berilgan.
Ma'lumotlar "thisisyourdigitallife" deb nomlangan shaxsiyat viktorina ilovasi orqali to'plangan. Taxminan 300 000 foydalanuvchi psixologik testni o'tgan, ammo keyinchalik ilova ularning do'stlari bilan bog'liq ma'lumotlarni ham to'plaganligi ma'lum bo'ldi va natijada 87 million profil ma'lumotlar to'plami yig'ilgan.
Meta 2015-yilda ilovani platforma siyosatini buzganligi uchun taqiqlagan. Kompaniya shuningdek, Cambridge Analytica'ga to'plangan ma'lumotlarni o'chirish bo'yicha huquqiy so'rov yuborgan. Ma'lumotlar janjalidan so'ng, Cambridge Analytica 2018-yil may oyida darhol faoliyatini to'xtatishini e'lon qildi. E'tiborga molik jihati shundaki, kompaniya 2016-yilgi prezidentlik saylovlari davrida Donald Trampning kampaniyasida ishtirok etgan.
"Bu Nyu-Meksiko va butun mamlakat bo'ylab iste'molchilar uchun tarixiy kun," dedi Nyu-Meksiko Bosh prokurori Raul Torres. "Juda uzoq vaqt davomida kuchli texnologiya kompaniyalari o'zlarining hajmi va ta'siri ularni qonun doirasidan tashqarida qoldiradi deb harakat qilishdi."
2022-yil dekabr oyida Meta Cambridge Analytica bilan foydalanuvchilarning ma'lumotlarini noto'g'ri ulashganligi ayblovi bilan bog'liq sinfiy da'voni hal qilish uchun 725 million dollar to'lashga rozi bo'ldi. Avvalroq, 2019-yilda AQSh Federal Savdo Komissiyasi tomonidan Facebookda foydalanuvchilarning maxfiyligini nazorat qilish qobiliyatini zaiflashtirganligi uchun 5 milliard dollar jarima solingan.
Avgust oyida kompaniya Nyu-Meksiko va Floridadan tashqari deyarli barcha AQSh shtatlari va hududlari bilan kelishuvga erishib, keyingi o'n yil davomida 18 milliard dollar to'lash va Facebook hamda Instagramda bolalar xavfsizligi bo'yicha kuchliroq choralarni joriy etishga rozi bo'ldi. Bu shuningdek, Cambridge Analytica bilan bog'liq da'volar uchun 459 million dollarni ham o'z ichiga oladi.
Meta bosh huquqiy direktori S.J. Mahoni so'nggi jarimani tanqid qildi va kompaniya qarorga qarshi apellyatsiya berish niyatida ekanligini qo'shimcha qildi.
Social media giant Meta was ordered to pay 25 billion in penalties by a New Mexico court on Wednesday as part of a data privacy lawsuit that sprang from the company's Cambridge Analytica data scandal, which came to light in 2018.
According to multiple reports from the Associated Press, the New York Times, Reuters, and the Wall Street Journal, state District Court Judge Francis J. Mathew called out Meta and Facebook for making misleading statements about the privacy of consumers in the state.
"Facebook promised users that they (the users) controlled their data," Mathew wrote in his ruling. "This was false."
The penalty relates to more than 43 million violations of the state's unfair practices law. The case, filed in 2021, was filed in the aftermath of revelations that Cambridge Analytica, a British political consulting firm, obtained data belonging to millions of Facebook users without their consent to build psychographic profiles.
The data was collected via a personality quiz app called "thisisyourdigitallife." Around 300,000 users are said to have taken the psychological test, although it later emerged that the app also collected the data associated with their friends, thereby amassing a dataset of 87 million profiles.
Meta banned the app in 2015 for violating its platform policy. The company also sent a legal request to Cambridge Analytica to delete the collected data. Following the data scandal, Cambridge Analytica announced in May 2018 that it was immediately ceasing operations. Notably, the company was involved in Donald Trump's campaign during the 2016 presidential election.
"This is a historic day for New Mexico and for consumers across the country," said New Mexico Attorney General Raúl Torrez. "For too long, powerful technology companies have operated as though their size and influence put them beyond the reach of the law."
In December 2022, Meta agreed to pay $725 million to settle a class-action lawsuit that accused the company of improperly sharing users' information with Cambridge Analytica. Previously, it faced a $5 billion fine from the U.S. Federal Trade Commission in 2019 for undermining users' ability to control their privacy on Facebook.
Back in August, the company also reached a settlement with nearly all U.S. states and territories, except New Mexico and Florida, to pay $18 billion over the next decade and implement stronger child-safety measures on Facebook and Instagram. This also includes $459 million for claims related to the Cambridge Analytica matter.
Meta chief legal officer C.J. Mahoney criticized the latest penalty, adding the company intends to appeal the decision.
